CN Rail blamed for collision on Pulpmill Road

ICBC seeking $95,243.32 for loss of commercial truck

ICBC says CN Rail is fault for a collision in Prince George that wrote off a commercial truck.

In a notice of civil claim filed March 22, the insurer is seeking $95,243.32 plus interest and any further relief as the court may deem just from the company for the loss of a 2019 Freightliner tractor on Nov. 12, 2020 on Prince George Pulp Mill Road.

Other than to say that the tractor was "struck by rail cars being negligently operated by employees of the defendant," details on how the collision occurred were not provided. In the alternative, employees of Canfor Pulp were to blame, the insurer asserts.

The tractor was being leased by Excel Transportation Inc. from Mercedes-Benz Financial Services Canada Corp., according to the claim.

The allegations have not been tested in court and the defendants have not yet filed responses.
