Ryan Miller was arrested at YVR on Canada Day, three years after the car crash, when he returned from a trip to Australia. He left for the country shortly after the Crown approved charges of driving with undue care and attention against him.

Miller will come before a judge for a pre-trial conference in May of 2012, and his full trial is set to begin on July 30 the same year.

Police and accident reconstruction specialists believe Miller, who was allegedly driving a BMW at the time of the accident, slammed into the back of the van without braking.

Two of three brothers sitting in the back row of of the minivan were killed, while the third brother was paralyzed. Two elderly women, who were sitting on the middle bench, were seriously injured along with a 49-year-old woman in the passenger seat and the mother of the three boys.

All eight family members were wearing seatbelts at the time of the collision.

A Toyota, driven by a 35-year-old woman, was also involved in the collision, hitting the driver's side door of the BMW.
